These Terms and Conditions govern your access to and use of Tiny Pits and Play’s services, facilities, website, bookings, rentals, and events. By visiting our venue, booking services, submitting forms, or using our website, you agree to these Terms in full.

If you do not agree, please do not use our services.

2.1 ABOUT TINY PITS AND PLAY

Tiny Pits and Play is a family-owned children’s indoor play and event business based in Houston, Texas. We provide indoor play sessions, private parties, soft play rentals, ball pit rentals, bounce house rentals, and related services for children and families.

These Terms apply to:

  • In-venue play sessions
  • Private parties and events
  • Equipment rentals
  • Website usage
  • Online and in-person bookings

2.2 ELIGIBILITY AND ADULT RESPONSIBILITY

All children must be accompanied by a parent, legal guardian, or authorized caregiver at all times unless otherwise agreed in writing.

By using our services, you confirm that:

  • You are at least 18 years old
  • You have legal authority over the child or children attending
  • You accept responsibility for the child’s behavior, safety, and supervision

Tiny Pits and Play is not a childcare or drop-off facility.

2.3 ACCEPTANCE OF RISK

Play involves physical activity. While we design our play areas to be soft, age-appropriate, and safe, risks still exist.

By entering the play area or using rental equipment, you acknowledge that:

  • Injuries may occur despite safety precautions
  • Children play at their own risk
  • You voluntarily assume all risks associated with participation

You agree that Tiny Pits and Play is not responsible for injuries caused by normal play activities, misuse of equipment, or failure to follow rules.

2.4 WAIVERS AND ACKNOWLEDGEMENTS

All participants must have a signed waiver on file before participating in play, parties, or rentals.

Waivers:

  • Must be completed by a parent or legal guardian
  • Apply to all children listed
  • May be required again for future visits or events

Failure to complete a waiver may result in denied access without refund.

2.5 HEALTH, SAFETY, AND CONDUCT RULES

To protect all families, we require the following:

  • Children must be healthy and free from contagious illness.
  • Shoes, food, and drinks are not allowed in play areas unless stated.
  • Aggressive behavior is not permitted.
  • Equipment must be used as intended.
  • Age and size guidelines must be followed.

Tiny Pits and Play reserves the right to:

  • Remove participants who violate rules.
  • End play sessions without refund if safety is compromised.

2.6 SUPERVISION POLICY

Parents and caregivers must:

  • Remain on-site during play sessions
  • Actively supervise children
  • Intervene when unsafe behavior occurs

Staff members provide general oversight, not one-on-one supervision.

2.7 BOOKINGS AND RESERVATIONS

Bookings may be made online, by phone, or in person.

By booking, you agree that:

  • All information provided is accurate
  • Booking confirmations are final once accepted
  • Time slots, dates, and packages are subject to availability

We reserve the right to decline or cancel bookings due to safety, capacity, or operational reasons.

2.8 PAYMENTS AND PRICING

  • Prices are listed in US dollars
  • Payment may be required in full or as a deposit
  • Taxes and service fees may apply

Tiny Pits and Play may update pricing at any time. Confirmed bookings retain the agreed price unless changes are requested.

2.9 CANCELLATIONS AND REFUNDS

Refund and cancellation rules are outlined in our Refund and Cancellation Policy, which forms part of these Terms.

General principles:

  • Late cancellations may forfeit deposits
  • No-shows are non-refundable
  • Weather, illness, or personal conflicts do not guarantee refunds

2.10 PARTY SERVICES AND EVENT RULES

Private parties include exclusive use of designated spaces for the agreed time.

Party rules:

  • Guest limits must be respected
  • Start and end times are strictly enforced
  • Decorations must be approved
  • Outside vendors may require approval

Hosts are responsible for:

  • Guests’ conduct
  • Damage caused by attendees
  • Following safety and cleanup guidelines

2.11 RENTALS AND EQUIPMENT USE

Rental equipment must:

  • Be used only as instructed
  • Be supervised by an adult
  • Be set up on approved surfaces

You agree:

  • Not to move or modify equipment
  • To keep equipment clean and dry
  • To return equipment in original condition

Damage, misuse, or loss may result in additional charges.

2.12 DELIVERY, SETUP, AND SPACE REQUIREMENTS

Clients are responsible for:

  • Providing sufficient space as stated
  • Ensuring access for setup and removal
  • Clearing obstacles from setup areas

Failure to meet space requirements may result in cancellation without refund.

2.13 PROPERTY DAMAGE AND LIABILITY

You accept financial responsibility for:

  • Damage to equipment
  • Damage to venue property
  • Damage caused by guests or children

Tiny Pits and Play may charge repair or replacement costs.

2.14 PHOTOGRAPHY AND MEDIA

Photos or videos may be taken during events.

  • Media use requires consent
  • You may opt out at booking
  • Personal photography is allowed unless restricted

We respect family privacy and comply with consent laws.

2.15 WEBSITE USE AND INTELLECTUAL PROPERTY

All website content is owned by Tiny Pits and Play.

You may not:

  • Copy or reuse content
  • Use images for commercial purposes
  • Misrepresent the business

Unauthorized use may result in legal action.

2.16 PRIVACY AND DATA PROTECTION

Personal information is handled according to our Privacy Policy.

By using our services, you consent to:

  • Data collection for bookings and safety
  • Secure storage and lawful processing

We do not sell personal information.

2.17 SERVICE MODIFICATIONS AND AVAILABILITY

Tiny Pits and Play may:

  • Modify services or schedules
  • Close temporarily for maintenance
  • Cancel sessions for safety or emergencies

We will make reasonable efforts to notify customers.

2.18 FORCE MAJEURE

We are not liable for delays or failures caused by events beyond our control, including:

  • Severe weather
  • Power outages
  • Government orders
  • Emergencies

2.19 LIMITATION OF LIABILITY

To the fullest extent permitted by Texas law:

  • Tiny Pits and Play is not liable for indirect or incidental damages
  • Liability is limited to the amount paid for the service

This applies even if we were advised of possible damages.

2.20 INDEMNIFICATION

You agree to indemnify and hold harmless Tiny Pits and Play, its owners, staff, and partners from claims arising from:

  • Your use of services
  • Your child’s actions
  • Breach of these Terms

2.21 GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the State of Texas.

Any disputes shall be resolved exclusively in courts located in Harris County, Texas.

2.22 SEVERABILITY

If any provision is found invalid, the remaining sections remain enforceable.

2.23 UPDATES TO THESE TERMS

We may update these Terms at any time.

  • Changes take effect upon posting
  • Continued use means acceptance
